Disclosure and privacy
Risk disclosure
- Futures trading involves high risk and leverage, and you can lose more than you deposited.
- Past performance does not guarantee results. There can be losing trades and losing periods.
- The trades and amounts on this site are a simulation on past data (backtest), with commissions and without slippage. They are not a trading account statement, and in a real account the result can be different, including a loss.
- The strategy does not predict the direction of the market. It follows fixed rules.
- This site and the product are not investment advice and are not tailored to anyone's personal needs.
- TradingView and any firm that holds a trading account are third-party services. We have no relationship with, sponsorship from or endorsement by them. It is your responsibility to make sure your use meets their terms.
Terms of use
Draft for a lawyer's review1. The parties and your agreement
These terms are an agreement between you ("the user") and GONG ("we"). Confirming the terms in the members area, or using the strategy, means you agree to them. If you do not agree, do not use the strategy.
2. Your statements
- I am over 18 and legally able to enter into this agreement.
- I have read and understood these terms, and I agree to them of my own free will.
- I understand that futures trading involves high risk and leverage, including losing all the money I deposited and even more, and I act at my own responsibility.
- The money I trade with comes from a lawful source.
3. The product
GONG — Opening Momentum is a TradingView strategy for Nasdaq 100 futures. It follows fixed rules, marks trades on the chart and creates signals and alerts in TradingView. The subscription includes access to the strategy and its updates, and a members area on our site with an installation guide.
4. No investment advice, no fiduciary relationship
We are not licensed under the Israeli Regulation of Investment Advice, Investment Marketing and Portfolio Management Law, 1995. The product is a software tool. It is not investment advice or investment marketing, and it is not adapted to your personal needs or circumstances. We are a technology provider only: there is no fiduciary, portfolio management or advisory relationship between us. All decisions about your account, your risk and your settings are yours.
5. Risk and past results
Nobody can guarantee a profit in trading, and we do not promise one. Past performance does not guarantee future results. There can be losing trades and long losing periods. A stop does not guarantee the size of a loss: in a sharp move, a price gap, slippage or a technical failure the loss can be larger. The trades and amounts on our site are a simulation on past data (a backtest), and real trading results can differ, including losses.
6. Licence
We give you a personal, limited, non-exclusive and non-transferable licence to use the strategy, for the period of your subscription, on the TradingView account that bought it. You get a right of use only, not ownership of the strategy, the code or the content.
7. No sharing, distribution or commercial use
You may not share access to your TradingView account or to the members area, and you may not sell, rent, transfer or publish the strategy, its settings, the installation guide or any content from the members area. You may not use the strategy commercially beyond your own personal use, for example by selling signals to others or managing other people's money.
8. Intellectual property and confidentiality
All rights in the strategy, the code, the rules, the name, the logo, the site and the content belong to us. You may not reverse engineer, try to reconstruct the rules or the code, or copy them. Keep how the strategy works, its settings and the members-area content confidential, and do not pass them to others without our written consent.
9. Subscription, payment and cancellation
The subscription is bought on our TradingView page, where it also renews and is cancelled, under TradingView's terms. Refunds: according to TradingView's policy for Marketplace purchases. We do not see your payment details. When the subscription ends, access to the strategy and to the members area closes.
10. Blocking after a breach
If these terms are breached, for example by sharing access, distribution or unauthorised use, we may remove access to the strategy and to the members area, with no refund from us.
11. Your trading account, third-party services and failures
You choose where to hold your trading account and how to use the strategy's signals and alerts. You are responsible for checking that the terms of any firm that holds the account, and of any service you use, allow the way you use them. TradingView and any such firm or service are third parties, and we have no relationship with, sponsorship from or endorsement by them. We are not responsible for what they do, for changes on their side, or for any restriction, closure or loss of an account.
The strategy depends on third-party systems and market data. There can be failures, delays, wrong data, alerts that were not sent or arrived late, and communication problems. You are responsible for checking the settings, watching your account and stopping use when needed.
12. Changes to the service
We may update, change or stop the strategy, its settings, the site or the members area at any time.
13. Limitation of liability
To the fullest extent the law allows, we are not liable in any case for any damage, loss or expense, direct or indirect, incidental or consequential, arising from using the strategy, from being unable to use it, or from any failure, delay or error, including trading losses and loss of profit. You use the strategy entirely at your own risk.
14. Indemnity
You agree to indemnify us for any damage, expense (including legal fees) or third-party claim arising from a breach of these terms, a breach of the law or unauthorised use of the strategy.
15. Force majeure
We are not responsible for not providing the service because of circumstances beyond our control, such as war, a cyber attack, a system shutdown or failures at our providers.
16. Privacy
What we keep about you and why is set out in the privacy policy.
17. Governing law and jurisdiction
These terms are governed by the laws of the State of Israel only, and the competent courts in Israel have exclusive jurisdiction.
18. General
- Entire agreement: these terms are the whole agreement between us on this subject and replace any earlier statement or promise.
- Severability: if a section is found invalid, the other sections stay in force.
- Survival: the sections on intellectual property and confidentiality, limitation of liability, indemnity, and governing law continue to apply after the subscription ends.
- Updates: we may update these terms. A new version will be published on the site, and the members area will ask you to confirm it. Using the strategy after the update means you agree to the updated terms.
19. Contact
